Unmarried Parents (UPA)

General Information
To officially establish a parent-child relationship between a child (or children) and unmarried parents a Parentage case may be filed under the Uniform Parentage Act. Once parentage is established, the court may make orders for child support, health insurance, child custody, visitation, name change, reimbursement of pregnancy and birth expenses, and restraining orders. Establishing parentage is also used to secure benefits, such as social security, veteran's, and inheritance rights.

    Establishing paternity (noun: the state of being a parent (father). Parental Relationship means to have the court say "legally" who the parents of any child are, or were, at the time of the birth of the child(ren), when the parents were not married to one another at the time of the birth.

    Child Custody and Visitation (Parenting Time)

    NOTE: Legal Custody - "Sole" (one) or "Joint" (both) parents have the right and responsibility to make decisions relating to the child's health, education and welfare.
    NOTE: Physical Custody - "Sole" - child will live with and be under the supervision of one parent, subject to the power of the court to order visitation for the other parent. A parent with "Sole Physical" may have an advantage when it comes to moving away over the objection of the other parent. "Joint" means both parents will have significant periods of physical custody arranged to assure the child has frequent and continuing contact with both parents (need not be 50/50 or even parenting time).

    The procedure in an action under this part to change the name of a minor or adult child for whom a parent and child relationship is established pursuant to Section 7636, upon application in accordance with Title 8 (commencing with Section 1275) of Part 3 of the Code of Civil Procedure shall conform to those provisions, except that the application for the change of name may be included with the petition filed under this part and except as provided in Sections 1277 and 1278 of the Code of Civil Procedure.
